Terms of Service

Service description

Picshare provides a hosted platform that lets event hosts collect photos and videos from their guests through a shared QR code or link. Hosts create Events or Stories; guests upload media into them; the host manages, views, and downloads the resulting gallery. The service is accessed through picshare.io and is operated by USTechService Corporation.

Eligibility and accounts

You must be at least 13 years old to create a Picshare account. You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

Acceptable use

You agree not to use Picshare to upload, share, or store:

  • Content that is illegal in the United States or in the jurisdiction where the uploader resides.
  • Child sexual abuse material (CSAM). Any account found to have uploaded CSAM will be permanently terminated and reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement.
  • Spam, promotional content, or material unrelated to the event the gallery is for.
  • Harassment, threats, hate speech, or content that targets individuals or groups based on protected characteristics.
  • Malware, phishing payloads, or code intended to damage systems or extract data.

We reserve the right to remove content or suspend accounts that violate this section, with or without notice depending on severity.

Content ownership

You retain full ownership of the photos and videos you upload. By uploading, you grant Picshare a limited, non-exclusive, royalty-free license to store, process, transcode, and display that content solely for the purpose of operating the service and showing the content to the people you've shared it with. This license ends when you delete the content or your account.

Public Explore feed

Hosts may choose to opt a Story into the public Explore feed. Opting in grants Picshare a broader, non-exclusive license to feature, thumbnail, and display the opted-in content across the picshare.io domain and in Picshare's own promotional surfaces. You can remove a Story from Explore at any time; removal ends the broader license going forward but does not retroactively alter copies already cached in third-party systems we do not control.

DMCA and copyright

Picshare responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content hosted on Picshare infringes your copyright, send a takedown notice including the required elements under 17 U.S.C. § 512(c)(3) to abuse@picshare.io. We will respond promptly and, where appropriate, remove or disable access to the material.

Billing and subscriptions

Paid plans bill in advance on a monthly or annual basis through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period, and your account will revert to the Free tier. Refunds are handled as described on our pricing page.

Termination

You may delete your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a risk to other users or to the service. Where the situation allows it, we will give reasonable notice before termination.

Warranty disclaimer

Picshare is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, USTechService Corporation, its affiliates, and its personnel will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, profits, or revenue, arising from or related to your use of Picshare. Our total aggregate liability for any claim arising from these Terms or the service is limited to the greater of one hundred US dollars or the amount you paid Picshare in the twelve months preceding the event giving rise to the claim.

Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Macomb County, Michigan, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email to registered users at least fourteen days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
